What ADA compliance means for your city's sidewalk project

Rebuilding a sidewalk triggers a legal obligation, and in Texas a state review layer on top. Here is what compliance actually requires and where projects go wrong.

When a city rebuilds a sidewalk, it does not just trigger a construction project. It triggers a legal obligation. Under the Americans with Disabilities Act, altering a pedestrian route means bringing it up to current accessibility standards, and in Texas, the Texas Accessibility Standards add a state review layer on top. Cities that treat accessibility as a detail to sort out during construction end up with failed inspections, demolition of brand-new concrete, and change orders that were entirely avoidable.

The numbers that govern everything

Accessibility compliance mostly comes down to a handful of dimensions, and the tolerances are tight.

Running slope. The sidewalk along its direction of travel generally follows the roadway grade. Curb ramps are different: the ramp itself may not exceed a slope of 1:12, which is 8.33 percent. There is no tolerance above this. A ramp poured at 8.5 percent fails.

Cross slope. The tilt across the walking surface may not exceed 1:48, or roughly 2 percent. This is the requirement contractors bust most often, because concrete needs some cross slope to drain and the margin between drains properly and fails inspection is small. Good crews check cross slope with a smart level during the pour, not after the concrete sets.

Clear width. A continuous 36 inches minimum of unobstructed path. Utility poles, hydrants, sign posts, and tree wells all count as obstructions. A four-foot sidewalk with a pole in the middle of it is not compliant.

Detectable warnings. The truncated dome panels at curb ramps, in a color contrasting with the surrounding surface, covering the full ramp width. These exist so people using canes detect the street edge. Leaving them out, or installing panels that trap water and pop loose in a freeze, is a routine inspection failure.

Landings. Every curb ramp needs a level landing at the top, and level here means it too: maximum 2 percent slope in any direction. Missing or sloped landings are among the most commonly cited defects in municipal ramp work.

The Texas layer: TAS and the RAS review

Texas administers its own accessibility program through the Texas Department of Licensing and Regulation. Public projects with a construction cost of $50,000 or more must have their plans reviewed by a Registered Accessibility Specialist and be inspected after completion. This is not optional and it is not the same thing as your building inspection.

The practical implication for a city: the RAS review happens on the plans, so accessibility problems should be caught on paper. If your engineer's drawings show a ramp that cannot physically achieve 8.33 percent within the available right-of-way, the time to solve that is design, not the day the finishing crew is standing over wet concrete.

Where sidewalk projects actually fail

In our experience, failures are rarely about ignorance of the rules. They come from four practical gaps.

Existing conditions that do not fit the standard. Old downtowns have steep driveways, narrow rights-of-way, and buildings at back of walk. Compliant ramps sometimes require taking the ramp up the side street, rebuilding a driveway apron, or acquiring a sliver of easement. Pretending the geometry works when it does not is how projects stall.

Drainage versus cross slope. Flatten the walk to 2 percent and water has to go somewhere. If the design does not handle it, crews in the field will tilt the walk to drain it, and the inspector's smart level will find out.

Finishing crews without accessibility training. The difference between passing and failing is often a quarter inch over four feet. Crews need to know the numbers and carry the tools to check them mid-pour. Ours do, and we check ramps before the truck leaves the site.

Nobody measuring until the end. If the first slope measurement happens at final inspection, every defect is a demolition. Progressive verification costs nothing and saves everything.

Questions cities ask us

Do we have to fix every sidewalk in town?

No. The obligation to meet current standards attaches when you alter a route. But cities are expected to have an ADA transition plan that prioritizes barriers over time, and resurfacing a street generally triggers curb ramp upgrades at that street's crossings.

What if full compliance is technically infeasible on a specific corner?

The standards recognize technical infeasibility, but it must be documented and the design must comply to the maximum extent feasible. It is a justified exception, not an exit.

Who pays when a ramp fails inspection?

If the contractor built to plan and the plan was wrong, that is a design problem. If the plan was right and the concrete is not, that is ours to demolish and repour at our cost. Ask every bidder that question before you open envelopes.
